Hearing to determine if murder conviction thrown out

NEWPORT, Ky. (AP) — A court hearing in Campbell County will determine if a woman’s murder conviction will be thrown out because a juror didn’t report he had been convicted of a felony.

The Kentucky Enquirer (http://cin.ci/2bGJAHQ ) reports that 25-year-old Shayna Hubers’ trial is set to begin Monday afternoon.

Hubers was sentenced to 40 years in prison last year after a jury convicted her of killing 29-year-old Ryan Poston in his condominium.

The former juror, 53-year-old Dave Craig, indicated that he had never been convicted of a felony. He had previously pleaded guilty to falling behind on child support payments, but said he didn’t know the crime was a felony.

Deanna Dennison, the attorney who represented Craig, is handling Hubers’ appeal. Dennison recognized Craig’s name, ran it through court records and found the felony charge.
